Mobile App Policies
1. INTRODUCTION & PLATFORM ACKNOWLEDGEMENT
- These Mobile Application Terms and Conditions (“Terms”) govern your access to and use of all mobile applications (“Apps”) developed, operated, or published by the Company.
Platform Acknowledgement:
- You acknowledge that these Terms are concluded solely between you and the Company, and not with Apple Inc. or Google LLC. The Company, and not Apple or Google, is solely responsible for the Apps and their content.
2. ELIGIBILITY & EXPORT COMPLIANCE
You represent that:

You are at least 18 years old, or

You have obtained valid consent from a parent or legal guardian.
U.S. Export Compliance (Mandatory): You represent and warrant that:

You are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country; and
-
You are not listed on any U.S. Government list of prohibited or restricted parties.
3. LICENSE, MAINTENANCE & SUPPORT
License:
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any platform-approved device that you own or control.
Maintenance & Support:
- The Company is solely responsible for providing maintenance and support services for the Apps.
- You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance or support services.
4. USER-GENERATED CONTENT (UGC) – APP STORE MANDATORY
If an App allows you to upload content, store media, or interact with others (including AI chat):
Prohibited Content:
- You may not post content that is unlawful, abusive, defamatory, sexually explicit, harmful to minors, or otherwise objectionable.
Reporting Mechanism:
- The App includes a clear mechanism to report objectionable content or abusive behaviour.
Enforcement Commitment:
- All reports are reviewed, and appropriate action (content removal and/or user blocking) is taken within 24 hours, in line with App Store requirements.
5. AI FEATURES & CRISIS DISCLAIMER (LUCIA / PAWSCORE)
- Certain Apps include AI-assisted functionality.
Not a Human:
- You acknowledge that you are interacting with an automated system, not a human being.
No Professional Advice:
- AI outputs do not constitute medical, psychological, legal, or professional advice.
Crisis Disclaimer (Mandatory):

The Apps are not monitored by humans and are not crisis-intervention services. If you are experiencing emotional distress, suicidal thoughts, or are in danger:

Disengage immediately

Contact local emergency services

Or reach out to SADAG (South African Depression and Anxiety Group)

The Company shall not be liable for harm arising from reliance on AI-generated outputs.
6. CHILDREN’S DATA (LIFEARK)
Where an App processes personal information relating to minors:

Use is permitted only with verified consent from a Competent Person (parent or legal guardian)

The Company may require reasonable proof of guardianship (e.g. ID verification or parental email confirmation)

Consent may be withdrawn and data deleted upon request
7. PAYMENTS & SUBSCRIPTIONS
All in-app purchases, subscriptions, billing, and refunds are handled exclusively by:

Apple App Store, or
-
Google Play Store
Consumer Protection Act Notice:
- Subscriptions may auto-renew unless cancelled at least 24 hours before renewal via your Store Account settings.
8. INTELLECTUAL PROPERTY CLAIMS
- In the event of a third-party claim alleging that an App infringes intellectual property rights, the Company (and not Apple or Google) will be solely responsible for the investigation, defense, settlement, and discharge of such claim.
9. LIMITATION OF LIABILITY & PLATFORM BENEFICIARY
Liability Cap:
- To the maximum extent permitted by law, the Company’s total liability shall not exceed R500 or the amount paid by you in the preceding 12 months, whichever is greater.
Third-Party Beneficiary (Apple Mandatory Clause):
- You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple has the right to enforce these Terms against you.
10. GOVERNING LAW
- These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles.
